Incoterms 2010 effective starting January 1st 2011
The revised version of the Incoterms „Incoterms 2010“ has been published by the International Chamber of Commerce and will be effective starting January 1st 2011. The new eleven clauses – nine of them have been kept - are an updated version of the Incoterms 2000. The clauses DAF, DES, DEQ and DDU have been deleted in the new version, instead they have been replaced by DAT and DAP.
Important changes:- 11 instead of 13 clauses
- Creation of two classes of INCOTERMS - (1) rules for any mode or modes of transport and (2) rules for sea and inland waterway (INCOTERMS 2000 had four categories).
- DAF and DES clauses are replaced by the new clause DAP (delivered at place). The seller has to provide the goods at the arriving means of transport, ready for unloading at the appointed destination
- DEQ clause is replaced by new DAT clause. This clause is for all means of transport. The seller has to place a transport contract up to the named terminal at agreed destination port or city to place the goods unloaded at disposal
- Express reference to the use of "equivalent electronic records", if the parties agree or it is customary
- Allocation of parties' respective obligations to obtain or to provide information in order to obtain security-related clearances.
- Rules which are able to serve both domestic and international trade.
- Including an obligation to "procure" goods to reflect current practices in string sales.
